Criminal Cases

Nekea Washington, 42, Fort Wayne, violated probation by failing to comply with the directives of the Wells County Community Corrections program.

Ordered to serve 22 days in the Wells County Jail, credited as time served.

Probation terminates.

Washington sentenced March 6, 2018, on two counts of driving while suspended with a prior conviction for the same offense, a Class A misdemeanor. The two counts were from two separate cases in which Washington was arrested for committing the same offense.

Breanna Brickley, 28, rural Bluffton, pleaded guilty to failure to return to lawful detention, a Level 6 felony.

Sentenced to two years in prison, all suspended, and placed on probation for one year.

Ordered to submit a DNA sample and pay court costs and probation fees.

Brickley also violated her probation from a Sept. 24, 2021, sentencing for possession of methamphetamine, a Level 6 felony. For violating probation, she was ordered to serve 334 days in the Wells County Jail. 

Following her sentencing in 2021, Brickley was ordered to report to the Wells County Jail at 6 p.m. Sept. 24. Brickley failed to arrive.

Jordan Price McCray, 22, Bluffton, pleaded guilty to identity deception, a Level 6 felony.

Sentenced to a year in prison. The term of the sentence is to be served consecutively to a 504-day sentence meted May 10 for violating probation from a May 20, 2019, conviction for maintaining a common nuisance—controlled substance, a Level 6 felony.

On Nov. 26, 2021, Ossian police received a complaint of a northbound vehicle on Ind. 1 from 900N weaving within its lane. An officer spotted the vehicle at All American Ossian Deli, but it started to leave northbound again on Ind. 1, hung a right on 1050N and then a left on 450E. The officer then pulled it over after checking the license plate and discovering the registered owner, McCray, had a suspended driver’s license with multiple indefinite suspensions.

Timothy Larson, 22, Bluffton, pleaded guilty to invasion of privacy, a Class A misdemeanor.

Sentenced to 180 days in the Wells County Jail, with all but four days suspended — credited as time served, and placed on probation for 180 days.

Ordered to have no contact with his victim and pay court costs and probation fees.

Larson was charged with texting a female in January who was protected from him by a court order.

Marcia Lee, 42, Ossian, pleaded guilty to possession of a controlled substance, a Class A misdemeanor.

Sentenced to a year in the Wells County Jail, with all but two days suspended — credited as time served, and placed on probation for 363 days.

Ordered to a pay a $200 drug interdiction fee, court costs and probation fees.

As part of a plea agreement, a second count of possession of a controlled substance and one count of theft, both Class A misdemeanors, were dismissed.

Lee was an employee of the CVS Pharmacy in Bluffton.

In January, her supervisor noticed a pill for the prescription pain killer alprazolam lying on the floor of the pharmacy where the pill should not be located. At that point, he started to keep daily counts of the pain pills.

On Feb. 1, the pill count for alprazolam was 10 pills short of what it should be. A check of surveillance video from the store allegedly showed Lee handling a bottle of alprazolam when no alprazolam prescriptions had been ordered that day.

Management then interviewed Lee and she allegedly admitted to having stolen 150 one milligram alprazolam tablets, 50 two milligram alprazolam tablets, and 50 clonazepam tablets — also a prescription pain killer. The total loss to the store was $322.

Lee allegedly admitted to a Wells County Sheriff’s Department detective that she was selling the pills in order to raise funds to find a new place to live. She later contacted the Wells County Sheriff’s Department and admitted that she was not selling the pills but was using them herself for pain management. 

She reportedly told the investigating detective that she had been prescribed pain medications following a fall when she was living in Tennessee, became addicted to them and was trying to seek help.

Infractions

Terry Grabner, 22, rural Roanoke, admitted to driving while suspended. Ordered to pay $150. Charges of operating a vehicle with an expired license plate, operating a motor vehicle without insurance and operating a motor vehicle with false and/or fictitious license plate — where the license plate belongs on another vehicle — were all dismissed.

Charges of operating a motor vehicle without insurance, no valid driver’s license in his possession and improper headlights were all dismissed for James H. Wilson, 55, Bluffton.

Default judgment of $150 entered against Candace M. Fink, 32, Bluffton, charged with operating a motor vehicle without insurance and driving while suspended.

Avery J. Mittlestedt, 24, Bluffton; driving while suspended, Ind. 116 southeast of Meridian Road.

William Ogan, 57, rural Bryant; operating a motor vehicle without insurance and driving while suspended, Main Street at Washington Street.

Mary L. Welch, 70, Decatur; driving while suspended, U.S. 224 near 500W.

Civil Cases

Complaint for damages in an amount to be determined by the court or by an arbitrator if applicable filed by Michael Moore, as natural parent for of Brooklyn Moore, a minor, and Brooklyn Moore individually, against Edwin Pluimer, John Pluimer and State Fram Mutual Automobile Insurance Company, doing business as State Farm. The suit is claiming that Brooklyn Moore incurred hospital and medical expenses related to a traffic accident in which a car Moore was a passenger was struck by a vehicle operated by Edwin Pluimer at the intersection of 300W and Ind. 116 Aug. 6, 2020.

Complaint for payment of $17,392.28 filed by Three Rivers Federal Credit Union, Fort Wayne, against Trey Mettler, Ossian.

Complaints for possession and for non-payment of rent filed by BCG Capital LLC, Bluffton, against Amy Jellison, Bluffton, $1,848.89; Devon Anderson and Kendra Hawkins, Bluffton, $1,445.

Complaint for possession filed by D&D’s Hoosier Realty LLC, Bluffton, against Gregory Freeman, Bluffton.

Complaint for payment of $35,876.70 filed by Brothers Express Inc., Fort Wayne, against Multi Fiber LLC, Bluffton.

Criminal Cases

Plea of not guilty entered by Roderick L. Wilmont, 37, Winter Park, Fla., charged with non-support of a dependent child, a Level 6 felony. Bond set at $10,000.

As of Dec. 14, 2020, Wilmont was reportedly in arrearage on his child support $19,247.22.
