Edgar Gehovany Aquino Hernandez, 29, Montpelier, pleaded guilty to possession of cocaine and operating a vehicle with a blood alcohol concentration of .08 percent or more with a prior conviction for the same offense, both Level 6 felonies.

Sentenced to two years in prison on each of the counts with all but 10 days of each sentence suspended. The sentences are to be served concurrently. Credited for four days spent in confinement awaiting disposition of his case.

Ordered to serve 170 days of home detention, submit a DNA sample and pay court costs and probation fees. Driver’s license suspended for one year.

One count of operating a vehicle while intoxicated with a prior conviction for the same offense, a Level 6 felony, was dismissed.

At 11:21 p.m. July 3, sheriff’s deputies responded to the area of Ind. 124 and 300W on a report of a vehicle traveling south on 300W weaving all over the road. A deputy caught up with the vehicle at 300W and 1000S. The vehicle, a 2002 Pontiac Montana van, was reportedly weaving within its lane, so the deputy pulled it over.

The deputy observed in his report to the court that Hernandez appeared intoxicated, smelled of alcohol, and blew a .220 percent alcohol concentration equivalency on a Breathalyzer test. That is more than twice Indiana’s legal limit for intoxication of .08 percent.

During his book-in at the Wells County Jail, a jailer found a small plastic bag containing a white powder in one of Hernandez’s pockets. Reportedly Hernandez would later admit it was cocaine.

Order of conditional discharge granted to Lauren Marie Baker, 25, Bluffton, charged with possession of marijuana, a Class B misdemeanor and possession of drug paraphernalia, a Class C misdemeanor.

The duration of deferred proceedings is one year. If she follows all of the rules set by the Wells County Probation Department for the discharge, then after one year the charges against her will be dismissed.

Bluffton police and Wells County EMS responded to a Cari Drive residence in Bluffton Woods mobile home park July 7 on a report of a man suffering from a possible overdose. While assisting the man, police reported finding a glass pipe packed with burned marijuana sitting in plain view nearby on a small round side table.

Preliminary plea of not guilty entered for Heather R. White, 32, Markle, charged with resisting law enforcement, a Class A misdemeanor. Larry Mock appointed public defender.

On Aug. 24, law enforcement officers responded to an apartment at the Skyline Village apartment complex in Markle on a report of a fight. White reportedly attempted to stand between law enforcement and a man that was being placed into handcuffs for officer safety during investigation of the fight.
