James H. McQueary, 23, rural Keystone, violated the rules of a conditional discharge for charges of possession of marijuana, a Class B misdemeanor, and failure to use headlights between dusk and dawn as required, a Class C infraction. McQueary violated the rules  by being arrested in Allen County on charges of operating a vehicle with an alcohol concentration equivalency of .15 percent or more, a Class A misdemeanor, and operating a vehicle while intoxicated, a Class C misdemeanor.

Sentenced to 180 days in the Wells County Jail, all suspended, and placed on probation for one year.

Assessed court costs, probation fees and a drug interdiction fee of $200.

At 9:56 p.m. June 25, 2021, a Bluffton police officer pulled over a pickup truck driven by McQueary after noticing it did not have any headlights on.  The officer noticed the smell of raw marijuana coming from the vehicle and asked McQueary about it. McQueary reportedly gave a vague answer, so the officer told McQueary he was going to search his vehicle and asked him again if he had any marijuana in the pickup truck. McQueary then allegedly said that he did have marijuana in the vehicle, it was at his feet.

A search of the vehicle reportedly turned up a grinder with approximately a gram of marijuana inside it.
