Raymond Castillo III, 19, Portland, will spend 90 days in the Wells County Jail for failing to report the death of a minor last November.
Castillo was sentenced to one year in jail with all but 90 days suspended, 275 days of probation and five months of home detention. Castillo received 20 days of jail credit towards his sentence, leaving 70 days remaining. Castillo was also charged with theft, a Class A misdemeanor, and will serve the sentences concurrently.
According to the probable cause affidavit, Castillo, his juvenile girlfriend, additional juveniles, and the victim were spending time together at the victim’s grandparents’ home. The group reportedly took pills, smoked marijuana, and drank alcohol. Several witness statements say Castillo failed to report the overdose due to fear of being charged for using drugs and alcohol.
Castillo and his girlfriend reportedly called her father to pick them up rather than seeking help from authorities or alerting the victim’s grandparents, who were asleep upstairs at the time. The victim’s grandfather found the body on the floor, cold to the touch, hours after the two left the residence.
A toxicology report from the coroner declared the cause of death as an accidental overdose of fentanyl.
In June, Castillo was also arrested for criminal trespassing, a Class A misdemeanor. According to a probable cause affidavit, Castillo was reportedly a part of a group of juveniles who were issued the warning for taunting a child at Bluffton Woods. The charges have since been dismissed.
Castillo was again arrested in early August for failing to appear in court for this case on July 20. He also has a pending infraction for unlawful possession of tobacco. Castillo is ordered to pay court costs and fees in the amount of $524.20.
