Cynthis Marie Cushing, 33, listed as homeless, pleaded guilty of theft, wherein the value of the property stolen exceeds $750 but is less than $50,000, a Level 6 felony.
Sentenced to two years in prison, with all but 120 days suspended, and placed on probation for 610 days.
Cushing was credited for 112 days spent in confinement awaiting disposition of her case.
Ordered to pay court costs and probation fees.
As part of a plea agreement, seven counts of theft, wherein the value of the property stolen in less than $750, all Class A misdemeanors, were dismissed.
Cushing is a former employee of the Ossian Subway restaurant. On Sept. 29 and Oct. 1, 2021, she allegedly pocketed money customers paid for food. On Oct. 4, she reportedly dropped money customers had paid for food into a tip jar. On Oct. 15, she reportedly failed to make a deposit of $750. Then on three separate occasions — Oct. 19, 21, and 22 — she allegedly swept all money that had been placed on the counter by customers into a tip jar.
All of the alleged thefts were reportedly captured on the businesses’ video surveillance system.

Jay E. Roser, 61, Markle, pleaded guilty to operating a vehicle with an alcohol concentration equivalency of .15 percent or more, a Level 6 felony.
Sentenced to a year in prison, with all but 20 days suspended. The terms of the sentence are to be served consecutively with two sentences meted in Huntington County Superior Court. One is from a May 24, 2021, conviction for operating a vehicle with an alcohol concentration equivalency of .15 percent or more, a Class A misdemeanor and the other was from a March 15 conviction for operating a vehicle while intoxicated with a prior conviction for the same offense, a Level 6 felony; operating a vehicle with an alcohol concentration equivalency of .15 percent or more, a Class A misdemeanor; and driving while suspended, a Class A infraction.
In the Wells County case, all but 20 days of the sentence were suspended. He was credited for two days spent in confinement awaiting disposition of his case.
Ordered to undergo substance abuse counseling, submit a DNA sample and pay court costs and probation fees.
As part of a plea agreement, charges of operating a vehicle while intoxicated endangering a person with a prior conviction for the same offense, a Level 6 felony; driving while suspended, a Class A infraction; and open alcoholic beverage container during operation of a motor vehicle, a Class C infraction, were all dismissed.
On July 3, 2021, sheriff’s deputies responded to a report of a man in a vehicle stopped on U.S. 224 just west of the railroad crossing in Kingsland who appeared to be suffering from a diabetic episode.
The deputy that first arrived at the scene noted that Roser appeared impaired, but he could not be sure if it was because of a medical condition or because of something else. The vehicle was still in drive, so the deputy reached in and put the vehicle into park.
Roser denied being diabetic and allegedly admitted to having drank either whiskey or wine. A deputy noticed a bottle in a sack next to Roser’s leg and asked him what it was. Roser reportedly handed it to the deputy and it turned out be a nearly empty bottle of brandy.
Because Roser reportedly showed very poor balance and needed a walker to walk, the deputy did not perform field sobriety tests. Roser blew a .185 percent alcohol concentration equivalency on a Breathalyzer test.
Roser had been arrested twice in Huntington County in April for operating a vehicle while intoxicated — once on April 9 and again the following day on April 10, 2021.
