The Indiana Supreme Court Disciplinary Commission has formally reprimanded Wells County Prosecutor Andrew Carnall for misconduct.

The misconduct investigation began after Carnall self-reported an incident where he had asked to retrieve his son from the scene of a traffic stop. His son had been stopped by a Wells County sheriff’s deputy and was suspected of driving while intoxicated. His son was ultimately not arrested.

The disciplinary commission confirmed the details of the incident and determined that by doing so, Carnall violated Indiana Professional Conduct Rule 8.4(d), which states it is misconduct for a lawyer to engage in any conduct that is prejudicial in the administration of justice.

The disciplinary ruling stated: “(Carnall) readily admitted that he acted improperly, self-reported to the Commission, and has publicly and privately apologized and taken responsibility for his actions.”

In addition to a public reprimand, Carnall has been fined $273.46 for court costs. The Indiana Supreme Court justices were unanimous in this ruling, excluding Justice Christopher Goff, who did not participate.

Carnall has served as Wells County prosecutor since 2014. At the end of Carnall’s term, current Deputy Prosecutor Colin Andrews will take over the office.
