Preliminary plea of not guilty entered for Blainlee F. Wygant, 28, Bluffton, charged with operating a vehicle while intoxicated with a prior conviction; operating a vehicle with an alcohol concentration equivalency of .08 percent or more with a prior conviction for the same offense; operating a vehicle while intoxicated endangering a person less than 18 years of age — all Level 6 felonies; and disregarding a lighted signal, a Class C infraction.

State filed notice of intent to seek habitual vehicular substance abuse offender status for Wygant.

At 1:34 p.m. on Sept. 13, while patrolling Washington Street east of Main Street, a Bluffton police officer reported seeing a southbound vehicle — whose driver was later identified as Wygant — fail to stop for a red light. The officer pulled in behind the sport utility vehicle and pulled it over.

As the officer approached the side of the vehicle, he reported seeing Wygant light up a cigarette. The officer also noticed a small child seated in the back seat of the vehicle.

The officer asked Wygant if he had been drinking and Wygant allegedly admitted to having taken “a couple shots” after getting off work. The officer administered a portable Breathalyzer test which reportedly showed Wygant’s alcohol concentration equivalency to be .13 percent — well above Indiana’s legal limit for intoxication of .08 percent. The officer then asked the female passenger if she had been drinking and she reportedly admitted that she had. Allegedly a Breathalyzer showed her alcohol concentration equivalency to be .288 percent.

The officer further observed in his report that Wygant smelled of alcohol, appeared intoxicated and failed field sobriety tests.

He had prior convictions on Oct. 7, 2015 in Fulton County Superior Court and on March 21, 2018 in Wells Superior Court.

Preliminary plea of not guilty entered for Carter Andrew-Rose Jackson, 21, Bluffton, charged with operating a vehicle while intoxicated endangering a person, a Class A misdemeanor; criminal mischief, a Class B misdemeanor; reckless driving, a Class C misdemeanor; driving while suspended, a Class A infraction; and disregarding a stop sign, a Class C infraction. Allison Sprunger appointed public defender.

A sheriff’s deputy was driving with his wife in their van Sept. 12 when reportedly Jackson exited the construction site for the Wells County Highway Garage in a mud-caked 2004 Jeep Liberty. The action reportedly forced the deputy to drive the van off the road.

The deputy then followed the van observing it drive west in the eastbound lanes of 200S. The Liberty then allegedly ran the van off the road again as both vehicles were heading the same direction. The deputy noted in his report that he could clearly see a man was driving the Liberty with a woman in the passenger seat.

The Liberty turned east on 100S and accelerated to speeds close to 90 mph. At the Adams Street intersection, the deputy was able to get close enough to the van to read its license plate before it turned back south on Adams Street, then east on 200S, north on Clark Avenue and west onto Manor Drive. By this time, on-duty law enforcement personnel were closing in.

The Liberty then exited Manor Drive and headed north on Clark Avenue then turned east on Silver Street before finally pulling into a driveway. By this point, sheriff’s deputies and Bluffton police had closed in on and surrounded the Liberty. Allegedly Wygant then changed seats with the woman and claimed that she had been the driver of the Liberty. 

Reportedly she also insisted she was the driver until confronted with the possibility that she too could be arrested. At that point she allegedly admitted that Jackson had been the driver.

Reportedly Carter admitted to being intoxicated, smelled of alcohol, appeared intoxicated, failed field sobriety tests and blew a .152 percent alcohol concentration equivalency on a Breathalyzer test.

Miguel Nuñez Antonio, 33, Fort Wayne, pleaded guilty to knowingly or intentionally operating a motor vehicle while never having been issued a driver’s license, a Class C misdemeanor.

Ordered to pay a fine of $14.50 and court costs of $185.50.

A Bluffton police officer pulled over a 2018 Toyota Camry after clocking it at 42 mph-30 zone on Main Street near Wabash Street Aug. 1.

Antonio reportedly admitted to the officer that he had neither a driver’s license, identification nor a Social Security number 

Sentencing set for 9 a.m. Oct. 14 for Jennifer Renee Ostovich, 37, Bluffton, who pleaded guilty to possession of mthamphetamine, a Level 6 felony; possession of marijuana, a Class A misdemeanor; driving while suspended with a prior conviction for the same offense, a Class A misdemeanor; and false informing, a Class B misdemeanor.
