NOTICE BY PUBLICATION OF ADOPTION
TO: Unidentified Father
Unidentified Father is notified that Verified Petition for Adoption of child, Xavier Jordan-Dee Mykel Monce, born September 9, 2015, to Haley Margarett Foland and Unidentified Father, was filed in the office of the Clerk of the Wells Circuit Court, located at 102 W. Market St., Bluffton, IN 46714. The Petition for Adoption alleges that the consent of Unidentified Father to the adoption of Xavier Jordan-Dee Mykel Monce is not required because the Petitioners will prove by clear and convincing evidence that Unidentified Father is unfit to be parent and it is in the best interest of Xavier Jordan-Dee Mykel Monce to be adopted.
Also, the Petition for Adoption alleges that the consent of Unidentified Father to the adoption is not required because Unidentified Father has failed without justifiable cause to provide for the care and support of said child When able to do so as required by law or judicial decree for period of at least one year. Further, the Petition for Adoption alleges that the consent of Unidentified Father to the adoption is not required because Unidentified Father has abandoned or deserted Xavier Jordan-Dee Mykel Monce for at least six months immediately preceding the date of filing of the Petition for Adoption.
If Unidentified Father seeks to contest the adoption of the child, Xavier Jordan-Dee Mykel Monce, he must file motion to contest the adoption, in accordance With I.C. 1-19-10-1, in the above-named Court, not later than 30 days after the date of service of this notice.
If Unidentified Father does not file motion to contest the adoption within 30 days after service of this notice the above-named Court will hear and determine the Petition for Adoption. The consent to adoption of Xavier Jordan-Dee Mykel Monce will be irrevocably implied and Unidentified Father will lose the right to contest either the adoption or the validity of his implied consent to the adoption.
No oral statement made to Unidentified Father relieves him of his obligation under this notice. This notice complies with LC. 31-19-4.5-3, but does not exhaustively set forth person’s legal obligation under the Indiana Adoption Statutes. The person being served with this notice should consult the Indiana Adoption Statutes.
