PUBLIC HEARING NOTICE

NOTICE IS HEREBY GIVEN THAT: Brian Fennig and Michelle Fennig have filed with the Board of Commissioners of Wells County, Indiana a Petition to vacate a portion of Water Street, Main Street and Wabash Street, and Alley No. 8, all part of the Plat of New Lancaster, now Murray.

A public hearing will be held by the Wells County Commissioners on November 3, 2025, at 5:00 p.m., in the Commissioners Room in the Carnegie Annex Building, located at 223 W. Washington Street, Bluffton, IN 46714. At that time, all interested persons will be given the opportunity to be heard in reference to matters set out in the petition. The Board of Commissioners of the County of Wells may, after a public hearing on the petition, grant the request by the passage of an ordinance vacating the described portion of the Streets.

The petition and a copy of a survey showing the portions of the rights of way sought to be vacated, more specifically described below, are available for public inspection at the Wells County Auditor’s Office, 102 W. Market Street, Bluffton, IN 46714.

Tract 1 – 0.24 Acres (Wabash Street):

Part of the Southwest Quarter of Section 17, Township 27 North, Range 12 East of the Second Principal Meridian, Lancaster Township in Wells County, Indiana, also being part of the Plat of New Lancaster, now Murray, as recorded in Plat Book 2, Page 11 in the Office of the Recorder of Wells County, Indiana, and being based on an original survey by Corey A. McKinney, Indiana Professional Surveyor Number 22100029 of McKinney Land Surveying, Survey No. 4046, dated August 20, 2025, and being more particularly described as follows:

BEGINNING at a 5/8” bar with a “MCKINNEY LS22100029” identification cap marking the Northeast corner of Lot 31 in the Plat of New Lancaster (now Murray); thence South 88 degrees 34 minutes 09 seconds West (Indiana East SPC, 1983 bearing and basis of bearings to follow), a distance of 160.00 feet along the North line of said Lot 31 also being the South right-of-way line of Wabash Street to a 1” pipe at the Northwest corner of said Lot 31; thence North 01 degrees 08 minutes 06 seconds West, a distance of 66.00 feet to a 5/8” bar with a “MCKINNEY LS22100029” identification cap on the North right-of-way line of Wabash Street; thence North 88 degrees 34 minutes 09 seconds East, a distance of 160.00 feet along said North right-of-way line to a 5/8” rebar with a “HOEHN 87-0002” identification cap on the West right-of-way line of Main Street; thence South 01 degrees 08 minutes 06 seconds East, a distance of 66.00 feet along said West right-of-way line to the Point of Beginning. Containing 0.24 acres, more or less. Subject an existing storm line, and subject to easements of record.

Tract 2 – 0.28 Acres (Water Street):

Part of the Southwest Quarter of Section 17, Township 27 North, Range 12 East of the Second Principal Meridian, Lancaster Township in Wells County, Indiana, also being part of the Plat of New Lancaster, now Murray, as recorded in Plat Book 2, Page 11 in the Office of the Recorder of Wells County, Indiana, and being based on an original survey by Corey A. McKinney, Indiana Professional Surveyor Number 22100029 of McKinney Land Surveying, Survey No. 4046, dated August 20, 2025, and being more particularly described as follows:

Commencing at a 5/8” bar with a “MCKINNEY LS22100029” identification cap marking the Northeast corner of Lot 31 in the Plat of New Lancaster (now Murray); thence South 01 degrees 08 minutes 06 seconds East (Indiana East SPC, 1983 bearing and basis of bearings to follow), a distance of 61.42 feet along the East line of said Lot 31 also being the West right-of-way line of Main Street to the Southeast corner of said Lot 31, said point being the POINT OF BEGINNING of the herein described tract; thence continuing South 01 degrees 08 minutes 06 seconds East, a distance of 70.58 feet along the West right-of-way line of Main Street to a 5/8” bar with a “MCKINNEY LS22100029” identification cap on the Southerly right-of-way line of Water Street; thence North 70 degrees 23 minutes 25 seconds West, a distance of 196.09 feet along said Southerly right-of-way line to a 5/8” bar with a “MCKINNEY LS22100029” identification cap; thence North 19 degrees 36 minutes 35 seconds East, a distance of 66.00 feet to a 5/8” bar with a “MCKINNEY LS22100029” identification cap at the Northwest corner of said Lot 31; thence South 70 degrees 23 minutes 25 seconds East, a distance of 171.09 feet along the Southwesterly line of said Lot 31 also being the Northerly right-of-way line of Water Street to the Point of Beginning. Tract 3 – 0.20 Acres (Main Street):

Tract 4 – 0.02 Acres (Alley No. 8):

Part of the Southwest Quarter of Section 17, Township 27 North, Range 12 East of the Second Principal Meridian, Lancaster Township in Wells County, Indiana, also being part of the Plat of South Addition to New Lancaster, now Murray, as recorded in Plat Book 2, Page 2 in the Office of the Recorder of Wells County, Indiana, and being based on an original survey by Corey A. McKinney, Indiana Professional Surveyor Number 22100029 of McKinney Land Surveying, Survey No. 4046, dated August 20, 2025, and being more particularly described as follows:
