Michael K. O’Rourke is notified that a petition for adoption of a minor child, named S.S.A.O. born on January 20, 2015, was filed in the office of the clerk of Wells County Circuit Court, located at 102 W Market St. #301 Bluffton, IN 46714, and reachable at (260) 824-6485. The petition for guardianship alleges that the consent to adoption of S.S.A.O. is not required because in accordance with I.C. 31-19-9-8 he has abandoned or deserted the minor child for at least six (6) months immediately preceding the date of the filing of the petition for adoption and/or that the child has been in the custody of another person if for a period of at least one (1) year; the parent: (A) fails without justifiable cause to communicate significantly with the children when able to do so; or (B) knowingly fails to provide for the care and support of the children when able to do so as required by law or judicial decree and in given that the biological Father has made no efforts to support or communicate with the minor children and has therefore abandoned the minor children.
If Mr. O’Rourke seeks to contest the adoption of the child, S.S.A.O., then Mr. O’Rourke must file a motion to contest the adoptions in accordance with IC 31-19-10-1 in the above named court not later than thirty (30) days after the date of service of this notice.
If Mr. Michael K. O’Rourke does not file a motion to contest the guardianship within thirty (30) days after service of this notice the above-mentioned court will hear and determine the petition for adoption. The consent to adoption of S.S.A.O. will be irrevocably implied and Michael K. O’Rourke will lose the right to contest either the adoption or the validity of Michael K. O’Rourke’s implied consent to the adoption.
No oral statement made to Michael K. O’Rourke relieves Michael K. O’Rourke of Michael K. O’Rourke’s obligations under this notice.
