Wells Circuit Court
Criminal Cases
Tyson Walter, 38, Auburn, violated probation by being arrested in Huntington County on charges of possession of methamphetamine, a Level 6 felony, and possession of marijuana, a Class B misdemeanor; and for possessing a controlled substance.
Ordered to serve 265 days in prison. Credited for 72 days spent in confinement awaiting disposition of his case. The term of the sentence is to be served consecutively with any term meted in Huntington County Superior Court.
Walter’s probation will terminate upon completion of the sentence
Walter was originally sentenced March 4 on one count of invasion of privacy with a prior conviction for the same offense, a Level 6 felony.

Russell W. Davis, 37, Bluffton, pleaded guilty to residential entry, a Level 6 felony — and he was found to be an habitual offender.
Sentenced to four years in prison. Credited for 107 days spent in confinement awaiting disposition of his case. Said credit of days are to be considered in assessing good conduct time credit.
A clinically appropriate substance abuse treatment program was recommended by the court for Davis.
As part of a plea agreement, charges of burglary of a dwelling, a Level 4 felony; theft, a Class A misdemeanor; and criminal mischief, a Class B misdemeanor were dismissed.
Davis was charged with breaking into the apartment of an acquaintance May 8, ransacking the apartment, causing damage to several items, and stealing several items including a guitar, cellphones and a camera.

Dustin Michael Everly, 26, Bluffton, pleaded guilty to arson, a Level 4 felony.
Sentenced to three years in prison. Credited for 146 days spent in confinement awaiting disposition of his case. Said credit of days are to be considered in assessing good conduct time credit.
Everly was recommended by the court to participate in purposeful incarceration. Upon successful completion of a clinically appropriate substance abuse treatment program as determined by the Indiana Department of Correction, the court will consider a modification to his sentence.
Officers responded to a residence on Central Avenue at 10:27 p.m. May 25 after Everly reportedly destroyed a TV belonging to his girlfriend and then allegedly attempted to set her house on fire by pouring gasoline along the east side exterior of the house and igniting it with a lighter. Everly then reportedly left.
Officers and sheriff’s deputies attempted to track Everly down but he couldn’t be found.
About an hour later, Everly reportedly returned to the house but left again. Then at 12:58 a.m., a law enforcement officer spotted a man matching Everly’s description and tried to get him to stop but he reportedly ran away.
Wells County Sheriff’ K-9 unit Leo and handler Sgt. Andrew Campbell were able to track Everly’s movement across the street from the Central Avenue residence to a shed where three kayaks were leaned against the side of the shed. Everly reportedly was curled into a ball behind one of the kayaks.

Pleas of guilty to dealing in a Schedule II controlled substance, a Level 3 felony; possession of methamphetamine, a Level 6 felony; and a seconded amended verified petition for revocation of suspended sentence and probation entered by Susan D. Sutton, 46, Bluffton.
Sentencing set for 9 a.m. Nov. 30.

Timothy O’Neal Davis, 40, Fort Wayne, pleaded guilty to battery resulting in bodily injury to a public safety official, a Level 6 felony, and invasion of privacy, a Class A misdemeanor. He was also found to be an habitual offender.
Sentenced to two years and 329 days in prison. Credited for 164 days spent in confinement awaiting disposition of his case. Said credit of days are to be considered in assessing good conduct time credit.
As part of a plea agreement, charges of domestic battery with a prior conviction for the same or a similar offense, a Level 5 felony; a second count of resisting law enforcement resulting in bodily injury to a public safety official, a Level 6 felony; battery resulting in bodily injury, a Class A misdemeanor; and disorderly conduct, a Class B misdemeanor, were all dismissed.
At 12:44 a.m. May 8, Bluffton police and other law enforcement officers responded to the corner of Market and Johnson Street on a report of a fight between Davis and his girlfriend at the time. Davis was located nearby at the Wabash Street Pak-A-Sak and placed under arrest.
Davis reportedly resisted officers’ attempts to place him into handcuffs and reportedly after being handcuffed, continued to yell at his victim, even after being told by officers to quiet down.
Davis reportedly struck the woman at a local bar and hit a drink out of her hand, which caused the drink to splash on the front of the shirt of a female companion who was with the woman.
Following his arrest and arraignment, a no contact order was put into place by the court to protect the woman whom Davis was accused of battering.
Davis reportedly tried to contact the woman through a hand written letter given to the jail staff addressed only to “wifey.” Upon further questioning, Davis reportedly admitted to investigators the letter was intended for the victim in the battery case.
