Criminal Cases

Mark Allen McVay, 26, Ossian, pleaded guilty to intimidation with a deadly weapon, a Level 5 felony.

Sentenced to 1,095 days in prison, all suspended. Credited for three days spent incarcerated awaiting disposition of his case. Placed on probation for two years. Ordered to submit a DNA sample, continue therapy, have no contact with his victim and pay court costs and probation fees.

Ossian police, sheriff’s deputies and a state trooper responded to the area of the Farmers & Merchants State Bank parking lot in Ossian May 18, 2021, on a report that a man — later identified as McVay — had brandished a .22 caliber rifle during a dispute with several Ossian residents.

The dispute was initiated when McVay reportedly nearly drove his car into a pickup truck parked along Melching Drive in Ossian near the baseball diamonds, then swerved to avoid striking it and nearly struck two boys riding scooters.

McVay, who lived nearby, pulled into a parking space at his duplex and allegedly started yelling at the people next door, apparently agitated by the pickup truck being parked partially in the street. The people left, but McVay allegedly followed them, nearly striking their pickup truck with his car. He then reportedly sped away but returned to the parking lot area where those involved with the earlier incident had gathered to discuss what had just happened.

McVay allegedly exited his car, retrieved the loaded rifle from the trunk and began walking towards the group. They then left.

A neighbor of McVay’s allegedly saw him return to the duplex and remove a rifle from his car and carry it inside the duplex. He allegedly also changed his clothing before law enforcement arrived and claimed he had been home during the time when the alleged incidents happened.
