NOTICE OF SUIT
The State of Indiana to Matt Fox, the Heirs of Kevin S. Fox, and any other person who may be concerned:
You are hereby notified that Kevin S. Fox is being sued by ProFed Federal Credit Union in Wells Superior Court, State of Indiana. The title of the case as shown by the Complaint is ProFed Federal Credit Union vs. Kevin S. Fox, Cause No.: 90D01-2201-MF-000001.
The nature of the suit is a Mortgage Foreclosure action wherein Plaintiff has filed a Complaint for In Rem Foreclosure demanding judgment for unpaid balance of the Mortgage and requesting that the property located at 0268 E. 1200 N., Ossian, IN 46777 be sold at a Sheriff’s Sale.
This Summons by Publication and Notice is specifically directed to Matt Fox, who ProFed believes to reside at 500 N. Maddox Street, Apt. 5, Markle, IN 46770.
You must answer or otherwise respond to the Complaint in writing, by you or your attorney, on or before the 13th day of May, 2022, (the same being within thirty (30) days after the publication of the third Notice of Suit, the last such notice of this action), and in case you fail to do so, judgment by default may be entered against you for the relief demanded by the Plaintiff in the Complaint.
If you have a claim for relief against the Plaintiff arising out of this occurrence that is the subject matter of the Plaintiff’s claims, you must assert it in your written answer.
