Criminal Cases

Carlos V. Martinez Jr., 47, Fort Wayne, pleaded guilty to possession of methamphetamine, a Level 6 felony; unlawful possession of a syringe, a Level 6 felony; operating a vehicle with a Schedule I or II controlled substance or its metabolite in his blood, a Class C misdemeanor; possession of drug paraphernalia, a Class C misdemeanor; possession of a Schedule I, II, III, or IV controlled substance, a Class A misdemeanor; driving while suspended, a Class A infraction; and no or improper headlights, a Class C infraction.

Sentenced to 545 days in prison on each of the felony charges, a year in the Wells County Jail on the Class A misdemeanor charge, and 60 days in the Wells County Jail on each of the Class misdemeanor charges. All of the sentences are to be served concurrently.

Credited for 250 days spent incarcerated awaiting disposition of his case. Assessed court costs of $185.50.

Driver’s license suspended for 30 days.

A Bluffton police officer pulled over a vehicle Martinez was driving on Main Street at 1:05 a.m. Jan. 5 after noticing it had a headlight out — and significant front end damage.

Martinez admitted to having been a vehicle crash with the car about three weeks earlier. A sheriff’s deputy, who arrived to assist with the stop, told the investigating officer that he could smell alcohol on Martinez’s breath and spotted two open alcoholic beverage containers.

The deputy performed standardized field sobriety tests. Martinez passed them. He also reportedly blew zeroes on a Portable Breathalyzer test.

The deputy then performed the SoToxa test on Martinez with his permission. SoToxa, which tests the contents of one’s blood through a saliva sample, allegedly showed the presence of methamphetamine and amphetamine. Martinez allegedly admitted to having smoked methamphetamine about three hours earlier.

Three pills allegedly identified as alprazolam, a Schedule IV controlled substance, was also reportedly found in Martinez’s possession.

Ronald A. Rose, 41, rural Wolcottville, pleaded guilty to one count of invasion of privacy, a Class A misdemeanor.

Sentenced to a year in the Wells County Jail, with all but eight days suspended — credited as time served, and placed on probation for 357 days.

Ordered to serve 90 days of home detention and pay court costs and probation fees. Ordered to have no contact with his victim.

As part of a plea agreement, four additional counts of invasion of privacy, all Class A misdemeanors, were dismissed.

Rose was charged with violating a protective order by calling the protected party’s cell phone on five separate occasions between late May and early June of 2021.

Andre T. Koker, 46, Fort Wayne, pleaded guilty to possession of marijuana, a Class B misdemeanor.

Sentenced to 180 days in the Wells County Jail, with all but eight days suspended — credited as time served, and placed on probation for 300 days. He may be considered for early release from probation.

Ordered to pay court costs and probation fees.

As part of a plea agreement, one count of possession of marijuana, a Class B misdemeanor, and failure to appear in court on the charges against him were dismissed.

Because Koker’s offense predates the current Odyssey court records system, there was no details from the probable cause affidavit in Koker’s electronic file to indicate what it was he did to be arrested.

Jordan Price McCray, 22, Kokomo, violated probation by failing to report to his probation officer April 9, 2020; failing to comply with a counseling requirement; failing to submit to drug tests Sept. 3, 2019; Sept. 16, 2019; Oct. 12, 2019; Oct. 22, 2019; Nov. 7, 2019; Nov. 22, 2019; Dec. 22, 2019; Jan. 17, 2020; Feb. 10, 2020; Feb. 28, 2020; March 13, 2020; May 1, 2020; and May 4, 2020; and for being arrested on one count of identity deception, a Level 6 felony.

Ordered to serve 504 days in prison and pay $100 in fees.

Upon completion of his term of incarceration, his probation will terminate.

McCray was originally sentenced May 20, 2019, on charges of maintaining a common nuisance — controlled substance, a Level 6 felony.

Infractions

Costs and fines of $150 entered against Alfredo V. Mendez, 29, Ossian, charged with driving while suspended. One count of operating a motor vehicle without insurance was dismissed.

One count of driving while suspended dismissed for Catarino Ybarra, 70, rural Bluffton.

One count of driving while suspended dismissed for Bernard M. Welch, 45, Bluffton.

Judgement of $137 entered against Kimberly S. Fraze, 57, Bluffton, charged with one count of no valid driver’s license in her possession. One count of operating a motor vehicle without insurance was dismissed. 

Civil Cases

Marriage of Jacoby Gibson and Courtney Gibson dissolved. Her former name of Moore restored to her.

Marriage of Elisa G. Cicatko and Michael C. Cicatko dissolved. Her former name of Bond restored to her.
