AN ORDINANCE AMENDING

Sections 13.12.010

and 13.12.020

of the City Code of

Bluffton, Indiana

WHEREAS, the Common Council of the City of Bluffton, Indiana, has authority under the Acts of the Indiana General Assembly to make all necessary regulations for the preservation of the rights, property, health, safety and welfare of its citizens; and

WHEREAS, the Common Council of the City of Bluffton, Indiana periodically reviews the Code of Ordinances for necessary or required amendments, has reviewed Title 13, Chapter 13.12 of the Code of Ordinances and now finds that the interests of the citizens of the City of Bluffton, Indiana will be best served by amending Title 13, Chapter 12, Sewage Rules And Rates, of the City of Bluffton Code of Ordinances, as herein provided.

NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF BLUFFTON, INDIANA AS FOLLOWS:

Section 1: Title 13, Chapter 12, Section 010 of the Code of Ordinances of the City of Bluffton, Indiana is hereby amended to add the following new subsection, “YY” to provide a new definition for the term: “Extensions to the City Sewage System”

“13.12.010

YY. “Extensions to the City Sewage System” – An Extension to the City Sewage System is a sanitary sewage system owned or operated by an entity other than the City, public or private, but which is connected to the City’s Sewage System.”

Section 2: Title 13, Chapter 12, Section 020 of the Code of Ordinances of the City of Bluffton, Indiana is hereby amended to add a new subsection “J”, as follows:

“13.12.020 General Provisions

J. Extensions to the City Sewage System. All Extensions to the City Sewage System must comply with Chapter 13.12 of the Code of the City of Bluffton. No Extensions to the City Sewage System may allow discharges to the City’s sanitary Sewage System that exceed the allowable limits, maximum or minimum, as listed in Chapter 13.12 of the Code of the City of Bluffton. No Extensions to the City Sewage System may allow the introduction of septic or grease into the City’s Sewage System. Only the Common Council of the City of Bluffton may authorize an Extension to the City Sewage System to connect to the City’s Sewage System. At the time an extension to the City’s Sewage System is permitted, the Superintendent shall make recommendations to the Board of Works and Public Safety for the purpose of setting a maximum allowable number of connections to be made to the Extensions to the City Sewerage System, and the Board of Works and Public Safety shall establish such allowable limits by resolution.”

This Ordinance shall take effect and be in force upon adoption and publication as required by law.
