NOTICE OF SUIT
The State of Indiana to the Defendants above named, and any other person who may be concerned: You are notified that you have been sued in the Court above named. The nature of the suit against you is a Complaint on Note and for Foreclosure of Mortgage on the following described real estate:
Part of the Southwest Quarter of Section 10, Township 25 North, Range 10 East, Jackson Township, Wells County, Indiana, described as follows: Commencing at the South Quarter corner of said Section 10, being marked by a 1 1/4“ steel bar found; thence Westerly on the South line of said South line of said Southwest Quarter 939.27 feet to a P.K. nail set marking the point of beginning; thence continuing Westerly on said South line, 200.0 feet to a P.K. nail set; thence Northerly, deflecting right 87 degrees 10 minutes, 290.0 feet to a standard corner marker (5/8” rebar with an aluminum cap stamped “Stoody, S-0144”) set; thence Easterly, deflecting right 92 degrees 50 minutes, parallel with the South line of said Southwest Quarter, 200.0 feet to a standard corner marker set; thence Southerly, deflecting right 87 degrees 10 minutes, 290.0 feet to the point of beginning, CONTAINING 1.33 ACRES OF LAND, more or less.
And Commonly known as: 8715 W 800 S-90, Warren, IN 46792
This Summons by Publication is specifically directed to the following named Defendants whose whereabouts are unknown to me:
David L Kilander and
Megan E. Hiester
In addition to the above named Defendants being served by this Summons, there may be other Defendants who have an interest in this lawsuit.
If you have a claim for relief against the Plaintiff arising from the same transaction or occurrence, you must assert it in your written answer.
You must answer the Complaint in writing, by you or your attorney, on or before the 28th day of June, 2013 (the same being within thirty (30) days after the Third Notice of Suit), and if you fail to do so, a judgment will be entered against you for what the Plaintiff has demanded.
