NOTICE OF THE FILING AND PENDENCY OF A PETITION TO VACATE A PORTION OF A
UTILITY EASEMENT
TO INTERESTED PARTIES:
You are notified that MMATT, LLP has filed with the Common Council of the City of Bluffton, Indiana, its petition to vacate the following described portion of a utility easement located in Lots 155, 156, 157, 158, 161, and 162 of the recently platted Northwood Farm Community, Section VII, in the City of Bluffton, Indiana:
Part of the Southwest Quarter of Section 22, Township 27 North, Range 12 East of the Second Principal Meridian, Lancaster Township in Wells County, Indiana, more particularly described as follows:
Commencing at the Southwest corner of said Southwest Quarter; thence North 89 degrees 27 minutes 45 seconds East, a distance of 1259.03 feet along the South line of said Southwest Quarter and within the right-of-way of Monroe Street to the Southerly extension of the East line of a 20 foot utility easement; thence North 00 degrees 22 minutes 06 seconds West, a distance of 639.93 feet along said extension and said East line to the Southwesterly line of Northwood Farm Community, Section 7, also being the POINT OF BEGINNING of the herein described easement vacation; thence North 18 degrees 51 minutes 16 seconds West, a distance of 63.08 feet along said Southwesterly line to the West line of said 20 foot easement; thence North 00 degrees 22 minutes 06 seconds West, a distance of 233.64 feet along said West line to the Southwesterly line of said 20 foot easement; thence North 36 degrees 24 minutes 23 seconds West, a distance of 307.20 feet along said Southwesterly line to the Southwesterly line of said Northwood Farm Community, Section 7; thence North 21 degrees 19 minutes 48 seconds West, a distance of 76.89 feet along said Southwesterly line to the Northeasterly line of said 20 foot easement; thence South 36 degrees 24 minutes 23 seconds East, a distance of 387.95 feet along said Northeasterly line to the East line of said 20 foot easement; thence South 00 degrees 22 minutes 06 seconds East, a distance of 299.97 feet along said East line to the Point of Beginning. Containing 0.282 Acres, more or less. Subject to easements of record.
You are further notified that this petition will be considered by the Common Council of the City of Bluffton in the Council Chambers at 128 East Market Street, Bluffton, Indiana, at 7:30 o’clock P.M. on the 23rd day of July, 2013. Persons interested in being heard, either in favor of or in opposition to such petition, are urged to attend. The Common Council may, after a public hearing on the petition, grant the request by the passage of an ordinance vacating the above described portion of the Utility Easement.
